Prosecution failure leads to acquittal of two in rape case

JAMMU, Feb 1: Presiding Officer YP Kotwal Fast Track Court has acquitted two accused namely Sushil Kumar and Joginder Pal who were facing trial in kidnapping and rape case, as prosecution miserably failed.
According to the police case on March 22, 2010 father of the prosecutrix lodged a missing report in police that on March 21, 2010 his daughter who was working in the house of Kashmiri Pandit had gone to his house for money and however, did not reach there and despite repeated search, he could not find her, subsequently on April 28, 2010 again came to police station and lodged a written report that he has come to know that Shushil Kumar and Joginder Pal kidnapped her daughter with criminal intention to rape her. Upon this police registered a case u/s 366/109 RPC and after recovery of the prosecutrix, section 376 was added and after completion of investigation challan was presented.
After hearing Advocates Yogesh Bakshi and PS Pawar appearing for the accused persons whereas APP for the State, Presiding Officer Mr YP Kotwal Fast Track Court observed that prosecution has failed to prove its case against he accused beyond reasonable shadow of doubt  and they are acquitted from the charges leveled against them.
