JAMMU, Feb 28: Principal Sessions Judge Poonch, Jaffer Hussain Beigh has acquitted Mohd Aslam and Showket Hussain, sons of Lal Din and Nazir Hussain, who were facing trial in gang rape case, as prosecution failed to prove the case.
However, court issued General Arrest Warrants against Showket Ahmed, Ghula, Nabi and Nazir Ahmed Sheikh, who were declared as absconder.
After hearing both the sides, court observed, “father and aunt of prosecutrix have not stated any thing against the accused persons because the father of the prosecutrix has lodged the missing report and he is not the witness of kidnapping or of any other overt act alleged against the accused persons”.
“Judicial notice cannot be issued against the present accused persons namely Mohd Aslam, Showket Hussain and Nazir Hussain”, the court said while acquitting them of the charges framed against them.
