HC not satisfied with JKCA scam investigation

Srinagar, Apr, 10: Jammu and Kashmir High Court today observed that Superintendent of Police East is not serious about investigating multi-crore Jammu and Kashmir Cricket Association (JKCA) scam directed his personal appearance before the court.
Expressing its dissatisfaction over the pace of investigations Division Bench of High Court comprising Justice MH Attar and Justice Ali Mohammad Magrey directed the investigating officer to remain present before the court on next date and explain his conduct with regard to the investigation.
Court while dealing with PIL regarding investigation in multi crore JKCA scam observed that the compliance report with regard to investigation of the scam is replica of earlier compliance report which shows non-seriousness of IO about investigation.
“The SP city east zone, Srinagar, it appears is not serious about the investigation of the case. The said authority is to explain his own conduct as there is already huge delay in conducting the investigation. The SP to appear in person on next date to explain his conduct”, directed the HC.
Court also pulled up Additional Advocate General (AAG) R A Khan, who represent police authorities, for delaying the investigation and observed to: “The issue involved in the PIL is very serious and delay in conducting investigation is beneficial only to the accused persons”.
The Instant PIL has been filed by the two persons – Majid Yaqoob Dar and Nissar Ahmad Khan – who remained to be the Ranji Trophy Player and Club Level Player respectively.
The petitioners are alleging that crores of rupees have been swindled by its so-called office bearers and called in question the said fraudulent device of using the said money of association for their personal use.
Petitioners are praying for investigation of matter by a high level team of reputed police officers or from any authorized department.
They also seek investigation of FIR No.27/2012 registered in Police Station Ram Munshi Bagh Srinagar and for bringing the guilty to book and to remove office bearers of JKCA who according to them have got themselves elected on 12.5.2014 fraudulently and dishonestly.
Those who have been arrayed respondents in the PIL include BCCI through its Secretary, Farooq Abdullah (President JKCA), Chief Secretary of the State,Director General of Police, SSP Srinagar, Ehsan Mirza, Saleem Khan and Moti Lal Nehru.
