DB’s directive in PIL on Sales Tax arrears

JAMMU, May 19: In a Public Interest Litigation (PIL) filed by Balvinder Singh and others regarding recovery of Sales Tax and VAT from all the defaulters, Division Bench of State High Court comprising Justice Hasnain Massodi and Justice Janak Raj Kotwal today directed the State to submit fresh status report.
After going through the status report, the DB observed, “the status report filed by respondents would indicate that recovery of tax arrears has been effected from 16 wine dealers during the period between 1.2.2015 and 31.03.2015 or necessary process initiated to ensure that the recovery is made in near future”, adding “the report, however, does not indicate the steps taken to make such recovery in case of wine dealers of Kashmir Division”.
“Status report further reveals that out of an amount of Rs 1.03 crore recoverable from JKEDA (Public Sector Undertaking) and Rs 77.21 lakh from JK Minerals Srinagar, only a meager amount of Rs 7,87,500 and Rs 6 lakh, stands recovered”, the DB said and directed that a fresh status report be filed by or before next date of hearing, wherein the steps taken to recover tax arrears from other defaulters as also wine dealers of Kashmir division and Public Sector Undertakings shall be indicated.
“The report must point out impediments, if any, in way of the recovery proposed to be made so that necessary orders are passed in the background of difficulties indicated”, the DB said.
