DB’s directives in PIL on noise pollution

JAMMU, May 27: In a Public Interest Litigation (PIL) filed by Vasu Dubey regarding violation of Noise Pollution (Regulation and Control) Rules, 2000 read with various provisions of the Environment (Protection) Act, 1986 and also seeking direction to implement guidelines issued by the Supreme Court, Division Bench of State High Court comprising Justice Hasnain Masoodi and Justice Janak Raj Kotwal today directed the respondents to submit comprehensive status report before next date of hearing.
The DB had earlier directed the respondents to submit status report indicating the steps taken towards implementation of statutory provisions to control noise pollution in the State. However, the respondents failed to submit the report sufficient in all essential details.
After hearing Advocate Rahil Raja appearing for the PIL whereas Senior AAG SS Nanda appearing for the State, DB directed Divisional Commissioners of Jammu and Kashmir to collect necessary information from all the Tehsildars/Chief Executive Officers of different development authorities in the State regarding implementation of the provisions and the directions laid down by the  Apex Court Judgment, tabulate such information and submit a comprehensive report well before the next date of hearing.
The DB also directed counsel for the PIL to file response before matter comes up for consideration.
