Prosecution failure leads to acquittals in rape case

JAMMU, June 5: Principal Sessions Poonch, Jaffer Hussain Beigh today acquitted four accused namely constable Farooq Ahmed, Ali Mohd, his wife Naseem Begum and SPO Ghulam Rasool as circumstances and facts proved that a false case has been lodged against the accused by the complainant party.
According to the police case, the prosecutrix was allegedly raped by Farooq Ahmed in connivance with Ali Mohd, Naseem Akhter and Ghulam Rasool on August 23, 2008.
After hearing both the sides, Principal Sessions Judge observed, “nothing is impossible in this world. The enmity is double edged weapon. The enmity can also be the motive of the crime as well as of false implication of the accused in the case. If there is enmity between the parties the offence like assault can be possible but the offence to commit rape is least possible”.
“In view of the enmity between the parties for their land dispute, there seem the ill intention of the prosecutrix and her father, her mother and sister-in-law to implicate the accused persons in some false case”, the court said.
With these observations, court acquitted the accused of the charges leveled against them.
