SRINAGAR, July 10: High Court today said that the ETT institutions in the State are not rendering any service to the society but are accumulating money by indulging in illegal activities.
“The status report, prima facie shows that some of owners of these ETT institutions have not been rendering service to the society but acted only from commercial point of view and have made huge assets by indulging in such type of dubious and illegal activities”, the Division Bench comprising Justice MH Attar and Justice Ali Mohammad Magrey observed.
“The report has made startling revelations about manner of setting up of ETT institutions and conducting of their affairs in the State”, court said.
Expressing deep concern and anguish over the irregularities in education stream, the Court today directed the Government and State Board of School Education authorities to adhere strictly to the norms while permitting to run the training colleges across the State.
The report of Crime Branch filed by IG Crime reveals that in some of the colleges teacher- student ratio is same by giving the reference of an institute which has admitted 127 students for undergoing ETT course but only one candidate was found in the institute and only one teacher was available there.
“The students, who are being admitted in these institutions, are mostly from outside the State of Jammu and Kashmir. Some students have been examined by the investigating agency and they admitted that they have not studied in the colleges and institutes where they were admitted for undergoing ETT course but attended the college only on the day of examination, where after they have been awarded certificates”, reveals the status report.
“To ensure that the students, who are admitted in these institutes do physically remain present during the entire period in which the course is to be completed, some measures have to be adopted”, court directed.
The Investigating Officer (Deputy Superintendent of Police) who was present in the court was questioned by the bench. He revealed in the open court that it has come to his notice that some officers and authorities are involved in the commission of offence under FIR No. 36/2013 registered in Police Station Crime Branch Jammu and submitted that he will proceed in the matter strictly in accordance with law.
“The IO also submitted that IG Crime, Jammu has issued instruction for conducting of investigation in a fair and unbiased manner and in view of the instructions of IG investigation will be concluded at the earliest”, court recorded in the order.
The status report of Crime Branch reveals that School Education Department Civil Secretariat has handed over 38 files to CB Jammu on June 16. However Education Department has failed to provide posting details of the officers.
Court said in order to stop further deterioration of the education system in the state; the authorities who are responsible in this regard have to chalk out a comprehensive and complete policy for granting permission for establishing and running ETTs.
Advocate General submitted before the court that all necessary steps will be taken up to ensure that the stream of education in the state is not polluted any further. “We hope and trust that State Government will take necessary steps to ensure that the education to the students is imparted in a manner it is required and steps will be taken by the Government to ensure that the laws are strictly enforced and followed and what has happened in the past is not repeated in the future”, court observed.
Court directed the Commissioner Secretary of the Education Department and investigating agency to file the latest status report in light of the observation made by the court before the next date of hearing.
