Court directs investigation into trespassing of JKCA office

Srinagar, July 24: In a new turn to the Jammu and Kashmir Cricket Association (JKCA) tussle between State Minister for Sports Imran Raza Ansari and President JKCA Dr Farooq Abdullah, the trial court today directed investigation into the trespassing into the office of the association by the newly elected JKCA body.
The 3rd Additional Munisff Srinagar Sunil Kumar ordered investigation into the matter and for filing the status report with regard to investigation carried into the matter by next date of hearing.
“Keeping in view the above facts and circumstances SHO Ram Muhshi Bagh is directed to investigate the matter in light of facts disclosing commission of cognizable offence in the application. SHO concerned shall file status report by or before next date of hearing”, court directed.
The trial court in an application filed by General Secretary, M L Nehru, and Chairman, Arvinder Singh Micky, through their counsel Javed Iqbal under Section 156(3) of CrPc for registering FIR against Ansari associates who according to the applicants while forming an unlawful assembly with common intention and common object, illegally and unauthorizely trespassed into the office of the Association at Sonwar by breaking open locks and causing loss and damage to the furniture and fixtures.
Allegation against trespassing and ransacking the office of Association has been made against Mehboob Iqbal, Iqbal Shah, Abdul Rouf, Javaid Ahmad Kitab, Rakesh Kumar, Mohammad Ashraf, Sudershan Mehta and Manzoor Ahmad Wazir.
It is stated that on coming to know about the incident attempted by the accused persons the office bearers of the Association including Joint Secretary, Treasurer, Vice Chairman and General Secretary immediately reported the matter to the President, Dr Farooq Abdullah, who without wasting any time lodged a written complaint to SHO Ram Munshibagh.
“The SHO assured action as warranted under law against the accused but did not take any action, compelling the applicants to forward copy of the said complaint to SSP Srinagar, who too failed to take action compelling the applicants to seek indulgence of this court”, reads the application.
Court kept the matter for further proceedings and filing of status of investigation by the SHO concerned on August 19.
