SRINAGAR, July 30: Government today informed the High Court that the panel headed by Justice Hakim Imtiyaz Hussain (Rtd) for Fee Fixation in private schools has been approved and the chairman has been provided with office and requisite staff.
Earlier Government in terms of the court direction appointed chairman of fee fixation committee but terms and conditions were not mentioned in the order of appointment of Chairman which court rejected with the observation that “it can’t give seal of approval to the appointment of chairman. Come up with clear stand”.
Today Government through its counsel S A Naik (AAG) who made a statement before the court said that the staff has been provided with the consent of chairman and office has also been identified and Estates Department has been directed to provide the same to the panel. “Provide the office by Monday”, directed the Division Bench comprising Chief Justice N P Vasanthakumar and Justice Hasnain Masoodi.
An order by the Deputy Secretary Education to for providing all the facilities to the panel was produced before the court. Captioned as urgent, it indicates that the panel requires one room and retiring room for chairman, one room for personal staff of chairman, waiting room with 10 person seating capacity, one room for each member of the panel, one room for staff, meeting hall with 20 person seating capacity and record room for Jammu as well as Kashmir.
Two members of the panel have also been nominated and in terms of Government order No.363-Edu of 2015 dated 28.7.2015 and Kaneez Fatima (representative of Board of School Education) and Showkat Ahmad Peer (Chartered Account) are the members of the panel. The appointment of the Chairman has been fixed for two years with the concurrence of the Finance Department.
An application was also filed mentioning therein that 10 schools are violating the court orders as they have and are asking for two months fee from the wards and their parents.
Court said that unless the FFC gives its clearance about the position of schools fee collected shall not be utilized and if any fee for the two months has been collected from the wards it shall be adjusted in future months.
“We make it clear that they shall approach the committee for clearance about the functioning of the schools and unless committee gives clearance the fee cannot be utilized and fee if any collected shall be adjusted in future months”, court directed.
