JAMMU, Aug 7: Division Bench of State High Court comprising Chief Justice N Paul Vasanthakumar and Justice Ali Mohammad Magrey today directed Jammu and Kashmir Bank to pay Rs 50,000 to a businessman for causing him harassment and damaging his image in public by getting his photograph punished as defaulter of the bank.
In the damages petition, the petitioner Farooq Ahmed Mir, who is selling articles under the name and style of “Kashmir Arts” submitted that action of the bank has tarnished his reputation and business interest as if he is a bankrupt and sustained business loss apart from mental stress. The J&K Bank published the photograph of the businessman as defaulter to the tune of Rs 16.72 lakh although actually the businessman had to pay only Rs 4.82 lakh.
Claiming Rs 15 lakh compensation with Rs 50,000 as costs, the businessman filed complaint against the J&K Bank before the Divisional Forum, Srinagar initially in November, 2011 which was returned by the Divisional Forum in view of valuation to be presented before the J&K State Consumer Disputes Redressal Commission, which awarded compensation of Rs 50,000.
Against the award, J&K Bank filed present appeal and DB after hearing both the sides dismissed the appeal of the J&K Bank with the direction to give Rs 50,000 compensation to the petitioner.
