Bail denied to narco-smuggler

JAMMU, Aug 28: Additional Sessions Judge Jammu, Rajesh Sekri has rejected the bail application of one Mosam Ali, son of Abdullah of Sidhra, who was arrested by the police for smuggling narcotics.
“As per the police report, the petitioner/accused Mosam Ali and his son Munir Hussain co-accused in the present case, are also facing trial in case FIR No. 275/2013 for offences u/s 8/21/22 NDPS Act and another accused namely Mohd Abbas is facing trial in case FIR No. 154/2014 for offences u/s 8/12/22 NDPS Act”, the court said.
“One of the considerations for grant or refusal of bail is the antecedents of accused. It appears that petitioner, who has been tried in case FIR No. 275/2013, was granted bail and he repeated the same offences”, the court further said, adding “given the circumstances, propensity of accused/ petitioner to jump over bail, tamper the prosecution evidence and repeat the same offence cannot be ruled out”.
With these observations, court rejected the bail application.
