SVO failure leads to acquittal of Executive Engg in DA case

JAMMU, Oct 30: Special Judge Anticorruption Jammu Sanjay Dhar today acquitted Sher Mohd. Khan, the then Executive Engineer PWD (R&B) Jammu, who was booked by the State Vigilance Organization in Disproportionate Assets case as the investigating agency failed to prove its case.
The Vigilance case was that Sher Mohammed Khan, the then Executive Engineer raised assets disproportionate to his known source of income. It was alleged that accused officer was in possession of commercial building at 65-Channi Himmat Jammu, two storoyed building at Bhatindi on a piece of land measuring one kanal and l0 marla, land measuring one kanal at Kursoo, Padshahi Bagh, Srinagar and had deposited lacks of rupees in various banks.
It was also alleged that the suspect possessed other valuable movable and immovable assets apparently disproportionate to his known source of income. During the check period from May 1992 to July 2004 he had assets worth Rs 54,18,0481. The accused was also found to have incurred an expenditure of Rs 5, 58, 205 on verifiable items of expenditure and 30% of his total salary was deducted on account of expenditure on non-verifiable items of expenditure incurred during the check period.
During the investigation it was revealed that total income of accused from salary after deducting expenditure on non-verifiable items and other sources had been Rs 38, 22, 517 and the value of assets disproportionate to his known source of income at Rs 21, 53, 736.
After hearing Advocate K S Charak for the accused persons, Special Judge Anti-corruption observed, “the prosecution has not been able to substantiate that the accused has committed the offences and is in possession of assets disproportionate to his known sources of income”.
“The instant case, as such, merits the acquittal of the accused”, the court said while acquitting the accused of the charges.
