Govt reserves right to transfer employees anywhere, anytime: HC

JAMMU, Oct 31: In a landmark judgment, Justice Dhiraj Singh Thakur today held that Government reserves the right to transfer employees anywhere and anytime.
The judgment was delivered while dismissing a petition filed by one Purshotam Lal challenging his pre-mature transfer.
Pleading from the respondents’ side, Additional Advocate General Ahsan Mirza apprised the court that the order under which the petitioner was taking shelter does not have any statutory force as the same is no longer in existence as it was ruled out by the full bench of High Court in a judgment in case titled Syed Hilal Ahmad & Ors Vs. State of J&K & Ors.
“There should remain some powers with the ruling authority so that in case of emergency any transfer can be made for the smooth running of the work of the Government and its related agencies”, AAG said.
“Only those employees take  excuses of pre-mature transfers who, somehow, have any disguised intention not to serve the employer by performing the duties”, he further submitted.
After hearing both the sides, Justice Dhiraj Singh Thakur observed, “the petition has no weight and hence the same is dismissed”.
