MoS Home, kin of Taj, Ansari among defaulters of Sales Tax

JAMMU, Sept 4: Division Bench of State High Court comprising Justice Virender Singh and Justice Muzaffar Hussain Attar will pass a detailed order in the Public Interest Litigation (PIL) seeking recovery of Sales Tax arrears worth crores of rupees from the defaulters while as Commissioner Commercial Taxes Department today filed Action Taken Report (ATR) wherein several VVIPs have been named as defaulters.
After hearing arguments of counsels for the PIL and Government for more than one hour, the Division Bench decided to issue a detailed order touching all aspects of Sales Tax arrears tomorrow. The DB, however, directed the Registry to list the PIL on September 25, 2012.
Earlier, the Commissioner Commercial Taxes Department, Kifayat Hussain Rizvi filed Action Taken Report (ATR) along with voluminous list of defaulters including Minister of State for Home Nasir Aslam Wani, Bashir Ahmed Wani of Wani House Raj-Bagh Srinagar (owner of M/s Gilston Joinery Mills Zainakote, Srinagar).
The other prominent defaulters included Arshi Taj, daughter of Taj Mohi-ud-Din, Minister for PHE, Irrigation and Flood Control, (owner of BOSS Milk Pvt Ltd Satwari), Highland Motors of Amjad Abbas and Imran Raza Ansari, son of Molvi Iftikhar Hussain Ansari, presently MLA PDP and others.
In the list of Kashmir Division, the name of Nasir Aslam Wani is figuring at Serial No 18 and he has been reflected as defaulter of Sales Tax for the year 2005-06 and 2006-07 for an amount of Rs 5,47, 543. Arshi Taj, daughter of Taj-Mohi-ud-Din has been declared defaulter for the year 2005-06 and 2006-07 for an amount of Rs 523125. Amjad Abbas Ansari and Imran Raza Ansari are the defaulters for an amount of Rs 18576708.
It has been mentioned that recovery proceedings have been stayed by Sales Tax Tribunal for an amount of Rs 78788166 and for rest of the amount summons have been issued vide No 45/DCK/REC dated August 23, 2012.
The other defaulters include Power Grid Corporation for an amount of Rs 492429147.07, BSNL Rs 254506705 (matter sub-judice in High Court), Shiva Gun Factory Rs 15774577 in the names of Dharam Chander, son of Sama Ram and Dhirandera Bramchari, Hindustan Petroleum Corporation Rs 5259001.55, JAKFED through GL Abrol (authorized signatory) for an amount of Rs 2989878, ASCOMS Sidhra Rs 1331972.
Balvinder Singh, an RTI activist, has filed the petition seeking recovery of Sales Tax arrears.
