Court awards 5 yr imprisonment for sodomy

Srinagar, Feb 8:  A local court here today awarded five years rigorous imprisonment to an accused after he was found guilty for attempt to sodomise a young boy about 37 years ago.
Accused was found guilty of sodomy last week by court and was awarded 5 years rigorous imprisonment today.
Counsel appearing for the guilty person submitted before the court that since the offence was committed in the year 1978 and presently the accused is in his sixties and is grandfather now and in case he is sentenced to imprisonment it may cause great hardship to him in the society.
Court turned down all these submission of the counsel and said that when these aggravating and mitigating circumstances would be weighed in balance would sub-serve the ends of justice.
“The aggravating and mitigating circumstances when weighed in balance, in the consideration opinion of the court a sentence less then as prescribed for the offence would sub-serve the ends of justice”, said the court of Additional Sessions Judge Srinagar presided by S R Gandhi while awarding quantum of punishment.
Court keeping in view of the law ordered that convict shall undergo rigorous imprisonment for five years for commission of offence u/s 377.
Court also fined the accused with Rs. 50,000 for the offence and said if the amount is realized from the accused the same be paid to the victim as compensation.
