JAMMU, Mar 5: Principal District and Sessions Judge Poonch, Tahir Khurshid Raina, while acquitting an accused of rape and kidnapping Nisar Ahmed of Balnoi Mendhar, has issued notice to prosecutrix for facing trial for commission of perjury.
The prosecutrix fully targeted the accused for commission of offence in her statement on oath before Judicial Magistrate Mendhar. However, at the time of her examination in Principal Sessions Court a quite contrary statement to it has been given by her absolving accused from commission of any offence with her.
The court observed, “she is a married and mature lady and she intentionally and deliberately shielded the accused and made contrary statement”, adding “it is high time to check this trend by initiating proceedings under Section 479-B of CrPC against such prosecutrix, who are misusing process of law and precious time of courts and of prosecution for their petty and nefarious interests”.
With these observations, the Principal District and Sessions Judge issued notice to prosecutrix for appearance before the court and face trial for commission of the offence of perjury.
