Life imprisonment awarded in murder case

JAMMU, Apr 28: Additional Sessions Judge Pulwama, Virinder Singh Bhou has awarded life imprisonment in a gruesome murder case.
According to the police case, one Vikas Lohar, a resident of West Bengal in the month of November 2010 committed the murder of Jogin Tati and accordingly he was booked under Section 302 RPC. After completion of investigation, police presented challan in the court of law.
During the course of arguments, Additional Public Prosecutor appearing for the State emphasized that the accused be punished with death penalty as he has committed the murder in gruesome manner.
On the other hands, Advocate G M Parvaiz (amicus curiae) appearing for the accused made prayer for taking a lenient view in the matter by keeping into consideration trauma and agony faced by the convict during the protracted trial.
After hearing both the sides, Additional Sessions Judge Pulwama, Virinder Singh Bhou observed, “it is not only the duty of the court but social and legal obligations are clearly enjoined upon it to impose adequate punishment according to law while taking into consideration not only the crime but also the criminal”, adding “furthermore, deterrence and reformation and primarily social goals which make deprivation of life and liberty reasonable as penal panacea”.
“Sentence of death is only deterrent and preventive but sentence of imprisonment for life is in addition to deterrent and preventive, also gives a chance to the criminal for reformation and of repentance while undergoing”, the court said.
With these observations, court awarded imprisonment for life to the convict and a fine of Rs 5000 for commission of offence under Section 302 RPC.
