Daily rated workers engaged prior to ban entitled for regularisation

Srinagar, June 16: Government today said the daily rated workers who have been engaged prior to imposition of ban are entitled for regularisation provided they fulfil all the requisite formalities.
In a written reply to a question of Jewan Lal in Lower House, Minister incharge PHE/ I&FC Department stated that daily-rated workers who have been engaged prior to imposition of ban are entitled for regularisation provided they fulfill all the requisite formalities as envisaged under SRO-64 of 1994, which includes completion of continuous seven years of service.
The Minister stated that daily rated workers engaged prior to imposition of ban are being paid their wages regularly under non-plan (Out Source of Up- Keep). “Need based Casual labourers engaged after imposition of ban up to 11/2005 are being paid their wages regularly under non-plan,” said the Minister.
The Minister also stated that need based casual labourers /NBCL in lieu of land engaged after November, 2015 are being paid their wages under O&M. Wages have been paid to these workers as per availability of funds.
In a written reply to a separate question of MLA Shakti Raj Parihar in Lower House, Minister incharge Finance stated that the contractual employees engaged up to 28-04-2010 are regularised under the provisions of J&K Civil Services (Special Provisions) act, 2010.
However, the provision of this act don’t apply to persons appointed in terms of Government order No. 125-GAD of 2001 dated 01-02-2001, on contract basis in the personal selection of the ministers or other authorities enjoying the status of the Minster, persons appointed on tenure posts co-terminus with the life of project or scheme of state or central Government and those appointed on academic arrangement for fixed term in any Government department, he added
“Detailed rules relating to regularisation of DRWs/WCEs engaged up to 31-01-1994 have been notified under SRO 64 dated 24-03-1994. These rules are applicable with effect from 01-04-1994, the Minister said.
In terms of these rules the daily rated worker/ work charged Employee to be eligible for regularisation should fulfil requisite conditions which shall also be applicable to such workers who were initially paid on H.R basis instead on the basis of Muster rolls, provided the status of such worker is recorded as daily rated worker in the initial engagement and was engaged prior to imposition of Ban, he added.
