HC’s directive to PSC on exam

JAMMU, June 22: High Court today directed the Public Service Commission to permit those applicants in written examination who have not received the admit cards.
The direction was passed in a petition filed by Ramandeep Kour and others, who have applied for the post of Lecturers (10+2) in Mathematics and deposited the examination fee. The petitioners submitted that they have not been issued admit cards for the examination scheduled for 26th June allegedly, on the grounds of not fulfilling the qualification but they are in the possession of certificates, which shows that they have been awarded the Master’s Degrees in Applied Mathematics.
After hearing Advocate Sandeep Bhat for the petitioners, Vacation Judge, Justice B S Walia observed, “counsel for the petitioners has referred to Rule-IX of the Jammu and Kashmir Education (Gazetted Services Rules, 1992) and Para No. 9 of Schedule-2 of the Jammu and Kashmir Education (Gazetted Services Rules, 1992) to contend that minimum qualification for direct recruitment to the post of Lecturer is Master’s degree in the relevant subject”.
“The counsel has further submitted that in view of the petitioners having Master’s degrees in Applied Mathematics they are eligible to apply and to be considered for selection to the post of Lecturers in Mathematics”, Justice Walia said, adding “the action of the respondents in not issuing admit cards to the petitioners for the written examination scheduled for 26th June, 2016 is absolutely arbitrary”.
With these observations, High Court issued notice to the respondents and directed PSC to permit the petitioners to provisionally appear in the Written Test for recruitment to the post of Lecturers  in Mathematics scheduled for 26th June, 2016.
It was, however, made clear that the permission to appear in the Written Examination was merely on provisionally basis and does not confer any right in favour of the petitioners and the rights of the petitioners would be subject to the outcome of the writ petition.
