HC’s order on Govt employee’s seniority issue

JAMMU, June 27: Division Bench of State High Court comprising Justice Mohammad Yaqoob Mir and Justice BS Walia today held that in case of appointment in Divisional Cadre posts, if the person has been transferred from Kashmir Cadre to Jammu Cadre on his request, his seniority is to be reckoned only from the date of his joining in Jammu Division and his prior service to the date of such transfer is not to be counted.
This far reaching judgment has been passed in a petition filed by Brij Krishan Bhat, who was appointed as Junior Assistant in Srinagar Court in 1968 and in the year 1986 he was transferred to Jammu Division and joined on December 11, 1986. He filed petition seeking that his seniority should have been reckoned from the date of his first appointment and thereafter promotions should have been granted on the basis of that seniority.
