Jailed undertrial gets HC order for admission to MBBS

In a ‘Munnabhai MBBS’ sort of case, an alleged fraud lodged in Rohtak jail has secured the Delhi High Court’s order to take admission to a government medical college in Chhattisgarh to study medicine.
Justice G S Sistani granted Uttar Pradesh native Ahmed (name charged) permission to take admission in Jagdalpur Medical College in Chhattisgarh on his plea that he had cleared the entrance test in July this year, but had been arrested by Haryana police on charges of forgery and impersonation in another medical entrance test.
The court allowed Ahmed’s plea as the counsel for both the Centre and the Chhattisgarh government did not oppose his plea.
Ahmed, a resident of Siddharth Nagar district in Uttar Pradesh, had told the court that he had cleared his counselling for MBBS in the jail but due to delay on the part of jail authorities, he was not able to reach the college in time in August this year for his admission.
The court asked the petitioner to report to the Government Medical College, Jagdalpur in Chhattisgarh on September 27 for admission in MBBS course in view of the last date of admission being September 30.
“Having regard to the peculiar facts of this case and the submission made by counsel for governments (Chhattisgarh and Centre) that they have no objection if the prayers made in thus plea are allowed and also taking into consideration that one seat is lying vacant with the Government Medical College, Jagdalpur, the petition is allowed,” said Justice Sistani.
The court also asked Ahmed to seek the Rohtak trial court’s direction to jail authority to take him to the medical college on or before the scheduled date.
“It is hoped that concern court will pass an order in accordance with the law…And also issue a direction to the police to ensure compliance of the order so passed,” the court said.
The court accepted the argument of the petitioner’s counsel Nasir Kamal that the FIR which has been lodged against Ahmed is not connected to the present medical examination.
In his plea, Ahmed had told the court that he had cleared the All-India Pre Medical/Dental Entrance Examination, 2012, conducted by the CBSE on July 3 this year and was declared successful for counselling and also allotment of a seat.
He said he, however, was arrested on July 15 by Rohtak police on charges of impersonation and forgery of document for cheating in another medical entrance examination.
He also said that he had cleared the online counselling from the Rohtak jail and he was offered a seat in Jagadalpur medical college for admission in MBBS course on August 27.
He added the concerned court had also allowed his plea and directed the jail to take him to the college for admission by 7 am on the admission date but due to delay on the part of police he had reached after the admission time was over by 5 pm. (PTI)
