JAMMU, Sept 24: State High Court today dismissed a petition filed by six members of J&K Medical Education Gazetted Services seeking quashment of advertisement notice for the enagement of Professors and Assistant Professors.
The petitioners were seeking quashment of Government Medical College Jammu’s advertisement notice dated June 1, 2012 whereby applications were invited from permanent residents of the State for engagement on “Academic Program Arrangement Basis” against available posts of Professor and Association Professor in 14 disciplines including of Orthopedics in terms of the J&K Medical and Dental Education Appointment on “Academic Arrangement Basis” Rules 2009.
They submitted that Professors/Associate Professors, who are selected and engaged on Academic Arrangement, should not interfere in the working of the petitioners as regular faculty members.
After hearing both the sides, Justice J P Singh observed, “petition is not only misconceived but an attempt to stall the process initiated by the State Government to urgently meet the deficiency presently existing in the teaching faculty of Jammu Medical College and to comply with the Medical Council of India Regulation, not only in the discipline of Orthopedics but in all the 14 disciplines”.
“Petitioners’ motion, which has resulted in delaying the selection process for engagement of Professors and Associate Professors in 14 disciplines in Medical College Jammu because of the interim directions therefore needs to be dismissed with costs”, the High Court further observed.
With these observations, High Court dismissed the petition with costs at Rs 6000. The interim directions dated August 30, 2012 were also lifted.
