Vigilance registered Case against Ex. Minister

SRINAGAR: A verification conducted by Vigilance Organization Kashmir on the basis of News Item published in Daily Greater Kashmir on 20 January 2011, reveals that then Tehsildar Shopian has processed and placed 190 cases for vesting of ownership rights to the occupations of state land before committee chaired by then Dy. Commissioner Shri Mohammad Ramzan Thakur on 16-06-2007. The committee approved only 17 cases out of 190 cases which included the case in respect of land under khasra No. 4/1 for 10 Kanals 16 Marlas in Estate Sedow under illegal occupation of Shri Taj Mohi-ud-Din. The verification revealed that the said land under the illegal occupation of Shri Taj Moh-ud Din is basically forestland and belongs to forest department. Verification has further revealed that the accused AC (R) after the gap of almost two months from the date of approval on 06-08-2007 sought no objection certificate from the concerned forest who vide their communication No. 4491/Land/Case dated 27-11-2007 communicated their objection against the vesting of ownership rights in favour of beneficiary Shri Taj Mohi-ud-Din on forest land. The concerned revenue officers instead of rejecting the case while considering the objection conveyed by Forest Department have vide their No. DCS/SQ/07/535 dated 01-12-2007 communicated forest authorities that the case stands already disposed off and the objections does not serve any purpose. Despite having the knowledge that the said land belonged to the forest department and in no way same can be processed for conferment of ownership rights under the provisions of J&K State Lands (Vesting of Ownership to the Occupants) Act 2001.

By acting in this manner, the then Dy. Commissioner Shopian Shri Mohammad Ramzan Thakur, Addl. Dy. Commissioner Shri Mohammad Youf Zargar, Assistnat Commisioner (R) Shopian Hafizullah Shah, then Tehsildar Shopian Shri Gh. Hasan Rather in connivance with other officers/ officials positions by illegal conferment of ownership rights upon the beneficiary over the land which belonged to the forest department.

Accordingly, Case FIR No. 18/2016 under section 5(1) (d) r/w 5 (2) J&K Prevention of Corruption Act, Svt-2006 and 120-B RPC in Police Station Vigilance Organization Kashmir was registered against Dy. Commissioner Shopian Shri Mohammad Ramzan Thakur, Addl. Dy. Commissioner Shri Mohammad Youf Zargar, Assistnat Commisioner (R) Shopian Hafizullah Shah, then Tehsildar Shopian Shri Gh. Hasan Rather and others and beneficiary Shri Taj-Moh-ud Din S/o Khuda Baksh R/o Batamaloo Srinagar.
