HC stays Designated Officer’s appointment in Drugs Deptt

JAMMU, Sept 8: State High Court today stayed the order regarding appointment of Designated Officer in Food and Drugs Department.
The stay was granted in a petition filed by Farid Ahmed Beigh seeking quashment of order whereby respondent has been posted as Designated Officer in Food and Drugs Depepartment. The High Court also directed the respondents to accord consideration to the representation of the petitioner filed by him earlier.
After hearing Advocate Abhinav Sharma appearing for the petitioner, Justice Janak Raj Kotwal observed, “Order No. FSAJK/112 of 2011 dated 03.09.2011 would show that 23 Food Inspectors (Executive) were appointed as Designated Officers, one of them for the entire State and 22 at district level each”.
“The officer figuring at Serial No. 15, Javeed Ahmad Beigh, was so appointed for district Kulgam. These appointments seem to have been made in order of seniority of the Food Inspectors in the Seniority List issued vide Notification dated 19.04.2010”, High Court said, adding “one Shallu Ram is the last person in order of seniority to be so appointed. In the seniority list, he figures at Serial No. 21 followed by petitioner, who figures at Serial No. 22 and Vide order No. 04-CFS of 2016 dated 03.08.2016, private respondent Zamer Ahmad, who figures at Serial No. 41 in the Seniority List has been appointed as Designated Officer for district, Kulgam”.
“The grievance of the petitioner is that being next in the seniority, he should have been so designated”, High Court said while granting stay.
