UDHAMPUR, Oct 28: Judicial Magistrate Ist Class (JMIC) Ramnagar, Renu Dogra has denied bail to an accused involved in the rape of a young girl.
While denying bail application of the accused, Arjun Singh, resident of Bela (Ramnagar), a Government teacher, the Judge ordered that since the accused used to treat the girl like his daughter publically as he had no own daughter, the accused after winning trust of the girl’s family then committed the offence under Sections 376/366/ 314 RPC. He does not deserve any concession in the form of bail.
” The offence committed by the accused is serious and heinous in nature and he can not claim it as matter of right. If the accused is granted bail at this stage, he may hamper and influence the investigations. Going by the nature of offence and severity of the punishment, the accused does not appear to be entitled to the grant of bail. Moreover, it will not be in public interest to allow the accused to move freely and confront with the victim and her family. From the statement of prosecutrix recorded under section 164-A CrPC prima facie, there are sufficient grounds to presume the involvement of accused in the crime. Therefore, the bail application of the applicant Arjun Singh is dismissed,” the Judge observed.
