CJM rejects bail of 2 in attempt to murder case

JAMMU, Nov 26: Chief Judicial Magistrate Reasi, Kamlesh Pandita today rejected the bail application of Darshan Kumar, son of Krishan Chand and Rahul, son of Madan Lal, both the residents of Reasi, who were allegedly involved in attempt to murder case.
After hearing both the sides, CJM observed, “the accused persons prima facie have committed a very barbaric act in which accused Rahul Sharma under the conspiracy of other co-accused chopped off the hand of the old lady who is struggling for her life in the hospital and whose statement has not been recorded till date because of her in-ability due to the murderous attack”.
“The accused Rahul Sharma appears to be minor as per original school certificate produced by his counsel. The juvenile in conflict with law has right to bail under Section 13 of the Juvenile Justice (Care and Protection of child) Act 2013 but at the same time, such right of the juvenile has been curtailed to some extent”, the court said, adding “the exception from the given facts and circumstances are apparently made out by the prosecution”.
“The ends of justice would not be served by releasing the accused persons at this stage when the lady is struggling for her life. The offence fastened on the accused person whether are made out or not cannot be looked into at this stage and would be definitely looked at the proper stage”, the court further said while rejecting the bail application.
“Accused Rahul Sharma is juvenile as such IO concerned is directed to keep him in juvenile home and produce him before this court on 06-12-2016 for further orders”, the CJM directed.
