JAMMU, Dec 14: Principal Sessions Judge Kathua Vinod Chatterji Koul today awarded life-imprisonment and fine of Rs 20,000 to Mohammad Ishaq, who committed murder of his real brother Bashrat Ali due to enmity.
“It is clear that charge for offences under Sections 302 RPC and 30 Arms Act stands established against the accused. He is, accordingly, convicted for offences”, Principal Sessions Judge said.
“Unless the crime perpetrated by an accused can safely be placed in the category of rarest of rare cases, the extreme penalty of death cannot be awarded. Accused is an old man aged about 50 years and there is nothing on record to show that he is a threat to the peaceful and harmonious co-existence of the society”, the court said, adding “there is nothing on record to show that accused has any criminal background”.
“The evidence on record shows that accused was inimical towards the deceased, as his wife has left him and she along with children was living in the house of deceased and on this reason, he committed the crime”, the court said while awarding life-imprisonment.
