HC seeks report on police surveillance of Malik

Srinagar, Dec 20 : High Court today directed the police to apprise the court as to whether Jammu and Kashmir Liberation Front Chairman Mohammad Yaseen Malik has been put under surveillance and for what reasons.
Justice MH Attar directed the police to follow the mandate of Article (19) (1) (d) and Article 21 of the Indian constitution as also the law laid down by the constitutional bench of Supreme Court in a Judgment of 1963 about liberty of a citizen to move freely throughout the territory of India.
Justice Attar directed the respondents to apprise the court on next date as to whether the petitioner has been put under surveillance, if so, for what reasons. “The respondents however, will not be prevented from proceeding in accordance with law if they feel that any action in terms of law is required to be taken”, court added.
Malik’s counsel submitted that without any right or reason and without following procedure established by law the personal liberty of the petitioner guaranteed under Article 21 of the Indian Constitution and Article 19 (1) (d) which guarantee right of a citizen to move freely throughout the territory of India is breached by action of respondents.
