JAMMU, Dec 24: Principal Sessions Judge Kathua Vinod Chatterji Koul today upheld two years Rigorous Imprisonment awarded by the trial court in acid attack case.
According to the police case, on August 17, 2003, an employee of PHE Department namely Sadhu Ram was admitted in the Government Hospital Basohli in an injured condition. In his statement to the police, he said that one Sonu had thrown acid on him over an old enmity.
After hearing both the sides, Principal Sessions Judge observed, “it is established beyond doubt that accused had thrown acid on the injured/complainant with a bucket, which resulted into serious injuries to him. The prosecution has proved the charge against the accused beyond any reasonable doubt”.
“He is, thus, found guilty for offences punishable under Sections 341/326 RPC. The trial court has convicted the appellant/accused and sentenced him to undergo simple imprisonment for one month and fine of Rs 500 for offence punishable under Section 341 RPC and simple imprisonment for two years and fine of Rs 5000 for offence punishable under Section 326 RPC”, Principal Sessions Judge further observed.
“The trial court has properly appreciated the evidence on record and rightly convicted and sentenced the appellant/accused for the commission of offences punishable under Sections 341/326 RPC”, the court said.
