DB directs Sessions Judge to take possession of entire complex

JAMMU, Mar 7: In a significant order, Division Bench of the State High Court comprising Chief Justice N Paul Vasanthakumar and Justice Alok Aradhe today directed Principal District and Sessions Judge Kishtwar to take possession of the entire old Deputy Commissioner’s office complex at Kishtwar within a period of three days in view of the letter already issued by the Deputy Commissioner, Kishtwar.
After hearing Advocate Sheikh Shakeel Ahmed with Advocates Irfan Khan and Rahul Raina appearing for Bar Association, Kishtwar and Senior AAG Seema Khajooria Shekhar appearing for the State Government, the Division Bench observed, “as per the letter of Deputy Commissioner, Kishtwar dated 04.03.2017, the Principal District and Sessions Judge, Kishtwar was requested to take over possession of the old Deputy Commissioner’s office complex, Kishtwar at an earliest, who in turn sought permission from the Registrar General of this court:.
“In the fresh status report filed by Divisional  Commissioner it has been categorically submitted that the directions of the Division Bench have been duly complied as the Deputy Commissioner Kishtwar has issued a clear cut communication to the Principal District and Sessions Judge to take over the possession of the entire old Deputy Commissioner’s  office complex at the earliest”, the DB said.
The DB issued directions for taking possession of complex within three days as Advocate I A Hamal, President, Bar Association, Kishtwar submitted that due to political intervention some vested interests are trying to scuttle the directions of the Division Bench.
After considering the submissions of Advocate S S Ahmed, the Division Bench allowed time to Bar Association Kishtwar to file its response to the fresh status report filed by Divisional Commissioner and directed the registry to list the matter on March 20.
