Deceitful transfer of land: CB presents charge sheet against accused

SRINAGAR, Apr 7: Crime Branch Kashmir today presented charge sheet against the accused persons, who had fraudulently got land of the complainant’s father transferred in their favour.
Charge sheet in case FIR No. 07/2015 for commission of offences U/S 420, 468, 471, 209, & 120-B RPC against accused persons namely Mohd Shafi Bhat, Gulzar Ahmad Bhat and Mohammad Yousuf Bhat, sons of Gh Hassan Bhat of Kanihama and Syed Akbar Shah son of Syed Murtaza Shah of Kanihama, Chadoura, Budgam, was presented   before the Court of Chief Judicial Magistrate Budgam.
The case was registered at Crime Branch Kashmir subsequent to an order passed by the Court of Chief Judicial Magistrate Budgam in complaint titled Bashir Ahmad Bhat V/S Mohd Shafi and others. It was inter-alia alleged that the accused persons had resorted to manipulation/fabrication of documents and thereby deceitfully and fraudulently obtained thumb impression of father of the complainant on the pretext of installation of a poultry farm but instead of installation of the poultry farm, secured a court decree in respect of land of which the complainant’s father was having ownership rights.
On the strength of cogent and clinching oral and documentary evidence coupled with opinion of forensic handwriting expert, the investigation  substantiated that the accused persons in furtherance of a well knit  criminal conspiracy,  deceitfully obtained the thumb impression of father of the complainant and  subsequently taken undue advantage of it by obtaining a court decree in their favour to transfer land measuring 13 kanals and 10 marlas situated at Kanihama, Chadoura  from ownership rights of  the complainant’s father.
