JAMMU, May 18: Principal Sessions Judge Kathua Vinod Chatterji Koul today awarded eight years imprisonment to Mohd Ayaz, son of Bashir Ahmad of Lohai-Billawar in a rape case and acquitted Zarina Begum, Hanifa Begum and Mohd Hussain for want of sufficient evidence to prove the charges against them.
After hearing both the sides, the court observed that Mohd Ayaz shall undergo imprisonment for a period of eight years and fine of Rs 50,000 under Section 376 RPC and in case of default in payment of fine he shall undergo a further imprisonment for one year.
“He shall also undergo imprisonment for a period of three years and fine of Rs 3000 under Section 363 RPC and in case of default in payment of fine he shall undergo a further imprisonment for three months. He shall also undergo imprisonment for a period of one year and fine of Rs 1000 under Section 344 RPC and in case of default in payment of fine he shall undergo a further imprisonment for one month”, the court said.
The court, however, clarified that all the sentences shall run concurrently and the fine, if deposited, shall be given to the prosecutrix/victim as compensation.
