22 years RI to Pak national

JAMMU, Oct 22: Principal Sessions Judge Jammu, Jang Bahadur Singh Jamwal today awarded 22 years RI and fine of Rs 30,000 to Khalid Pervaz alias Javed, son of Mohd Ali, resident of Narobal, who was working as an agent of Pakistan Army.
According to the police case, Javed, who was putting up in Bari Brahamana area by posing himself as a labourer working in the local factory, kidnapped the son of landlord. Accordingly, a case was registered and accused was arrested.
During investigation it came to fore that accused was actually a Pakistani national and was sending information regarding Indian Army through e-mail to Pakistan. It also came to light that accused was constable in Pakistan Police in the year 1997 and following registration of case against him under Section 307 he absconded and accordingly was dismissed from service.
In the year 2004, accused with the assistance of one Major Safdar made a fake passport and entered in the Indian Territory through Wagah Border in 2005 for seeking information regarding Indian Army. In June 2006, accused remained as tenant in Nanak Nagar by impersonating as one Mohinder and during this period accused was working as agent of Pakistan.  He was regularly sending information through ID – rarmk24@ yahoo.com to Major Safdar in Pakistan through his Mobile No.03006158081.
After hearing Public Prosecutor Shabir Choudhary appearing for the State whereas Advocate P S Pawar as amicus-curie for the accused, the Court convicted the accused. Under Section 3 EAO, he was awarded 10 years rigorous imprisonment and fine of Rs 10,000. In default of payment of fine, he will suffer further rigorous imprisonment for a period of one year.
Under Section 368 RPC, the convict was awarded rigorous imprisonment for a period of 10 years and fine of Rs 10,000. In default of payment of fine, he will suffer further rigorous imprisonment for a period of two years. The Court clarified that all the sentences shall run-concurrently. Court also directed that after the completion of sentences the convict may be sent back to his country.
