JAMMU, July 29: In a contempt petition filed by Secretaries of Chief Justice and Judges of the High Court, Division Bench of State High Court comprising Justice Alok Aradhe and Justice Sanjeev Kumar has granted four weeks time to the State for filing Action Taken Report (ATR) with regard to the proposal submitted by the Registrar General vis-à-vis providing of grades equivalent to KAS to the petitioners.
When the matter was taken up, H A Siddiqui, Senior AAG submitted that the directions dated December 17, 2015 have been complied with in as much as the respondents have implemented the decision taken by the Single Judge and have created the posts in question.
Senior Advocate Sunil Sethi appearing for the petitioners invited the attention of the DB towards Paragraph No. 15 and 16 of the judgment and submitted that once this court makes a recommendation with regard to up-gradation of the posts, the respondents have no power to sit over the proposal submitted by the Registrar General and has to comply with the same.
“Specific challenge was made to the additional directions contained in Paragraph No. 15 of the judgment by the appellants before the Supreme Court, however, SLP preferred by the respondents has been dismissed by the Apex Court vide order dated April 12, 2016 and, therefore, there appears to be no justification for non-compliance with regard to the proposal, which has already been sent by the Registrar General”, he further submitted.
Upon this, Division Bench granted four weeks time to the State for filing ATR.
