JAMMU, Aug 12: State High Court has rejected the bail applications of two persons in a gang rape case.
According to police case, on 05.03.2015 the prosecutrix was on her way to the house of her uncle. When she reached near village Ratti Chappdi, the petitioners Rashpal Singh and Balwant Singh forcibly pulled her into their vehicle. They drove the vehicle to an isolated place where they committed rape on her. They even threatened her of dire consequences if she dared to disclose the incident to anyone.
However, on next day the prosecutrix filed a complaint in the court of the Chief Judicial Magistrate, Jammu and then FIR was registered in terms of Section 156 (3) CrPC.
After hearing Advocate GS Thakur appearing for the petitioners whereas Government Advocate Sanjeev Padha appearing for the State, Justice Janak Raj Kotwal observed, “in view of the evidence of the prosecutrix as prosecution witness before the trial court, in my considered view, rigor of proviso to Section 497-C is strongly attracted in this case in as much as it cannot be said that accusation against the petitioners is not prima facie true”.
With these observations, court rejected the bail application.
