JAMMU, Sept 5: High Court has stayed the Government order whereby State Dental Council was constituted in terms of Section 21 of the Dentists Act, 1948.
The stay was granted in a petition filed by Dr Bhupinder Singh and others.
Advocate Parag Sharma appearing for the petitioners submitted that in a previous round of litigation, High Court by virtue of judgment and order dated May 6, 2017 had directed the State to hold the elections and constitute the Dental Council within two months.
“However, much before the process of election could be initiated and completed, the Government passed the order dated May 31, 2017 constituting the State Dental Council in terms of Section 21 of the Dentists Act, 1948”, he further submitted.
He vehemently urged that the order impugned was per se illegal inasmuch as without conducting an election in terms of J&K Dental Council (Election) Rules, 1997 as ordered by the High Court, the respondents could not have constituted the State Dental Council.
After hearing the counsel for the petitioners, Justice Dhiraj Singh Thakur stayed the operation of impugned order.
