Court acquits accused in murder case

JAMMU, Nov 15: Principal Sessions Judge Samba, Kartar Singh has acquitted Romal Singh, son of Thakur Ditta of Gunghar, Samba, an accused in murder case as the prosecution failed to prove its case against the accused beyond any reasonable shadow of doubt.
According to the police case, on December 27, 2009 one Sardar Singh, son of Daya Singh lodged an oral report in the Police Station Hiranagar regarding missing of his son Ashok Singh, who had gone to his shop at Londhi Morh but did not return back in the evening on December 25, 2009.
In the meanwhile, one Jasbir Singh came to his house and told him that Ashok Singh had come to his shop on a motorcycle and told him that he was going to village Gunghar and would return in the evening but he did not return.
During investigation, it came to fore that Trishla Devi, daughter of Romal Singh was having illicit relations with the deceased Ashok Singh for the last one and half years and on December 25, 2009 she had called Ashok Singh to Gunghar forest where Ashok Singh was murdered by Romal Singh in connivance with Trishla Devi.
After hearing PP for the State whereas Advocate S S Sambyal for the accused persons, Principal Sessions Judge Samba Kartar Singh observed, “Surinder Singh Billowria, SHO was key in this case to prove the material circumstances but he has not been examined by the prosecution. Hence the presumption is to be drawn against the truthfulness and veracity of the prosecution story”.
“In the final analysis, it is held that the prosecution has miserably failed to prove its case against the accused beyond any reasonable shadow of doubt”, the Court further observed and acquitted the accused of the charge framed against him.
