DB directives on encroachment of migrants’ property

JAMMU, Dec 9: In a petition filed by All India Kashmiri Samaj and Others highlighting encroachment of migrants property in Kashmir valley,  Division Bench of State High Court comprising Chief Justice Badar Durrez Ahmed and Justice Sanjeev Kumar has granted final opportunity to the Divisional Commissioner Kashmir for filing status report.
After hearing Senior Advocate P N Raina with Advocate J A Hamal for the petitioners, the DB said, “the status report shall clearly state as to whether the work of identification of the encroachment of the properties of the migrants in Kashmir division has been undertaken by the respondents”.
“The status report shall also indicate the steps taken by the respondents under Section 4 of the Jammu and Kashmir Migrant Immoveable Property (Preservation, Protection and Restrain on Distress Sales) Act, 1997, for maintenance of the properties of the migrants in Kashmir division after obtaining possession thereof within six weeks from today”, the DB further directed.
