Prosecution failure leads to acquittal of murder accused

JAMMU, Dec 1: 3rd Additional Sessions Judge Jammu, Sanjeev Gupta acquitted one Deepak Kumar, who was facing trial for committing murder of a woman, as prosecution failed to prove its case.
According to the police case, on September 20, 2009, badly decomposed body of a young lady was recovered from the bushes. Accordingly, police registered a case and started investigation.
During the course of investigation and after getting the call detail of mobile phone of deceased, the accused was taken into custody. The further investigation revealed that deceased was in illicit relationship with the accused for a quite long time and accused used to have sexual intercourse with the deceased on number of occasions.
When wife of the accused came to know about the relationship, the accused made a plan to do away with the life of deceased. The accused in order to get the treatment of her wife was visiting village Lehar and on one occasion accused found a Nokia mobile having a SIM at village Biaspur Parlah belonging to one Karan Kumar, who had misplaced it.
The accused cleverly remained in touch with the deceased on the number and on September 12, 2009 accused called the deceased to Miran Shaib and from there both went to Akhnoor where the accused switched off his mobile after receiving a call from his house and also persuaded the deceased to switch off her mobile phone. Thereafter, both of them boarded a matador and reached the place of occurrence where after having a sexual intercourse with the deceased, the accused with a criminal intention committed murder of deceased by strangulating her with a dupatta and flew away from the spot.
After completion of investigation challan was presented in the Court.
After hearing both the sides, 3rd Additional Sessions Judge Sanjeev Gupta observed, “the court is of the clear opinion that prosecution has failed to prove the guilt of the accused beyond reasonable doubt. The circumstances relied over by the prosecution could not connect the accused with the crime in any manner whatsoever”.
With these observations, Court acquitted the accused of the charges leveled against him.
