JAMMU, Dec 3: Presiding Officer TADA Court, Sanjeev Gupta today awarded double life-imprisonment to two militants of Hizbul Mujahideen namely Nazir Ahmed Sheikh alias Gul-Danter and Showkat Ahmed Khan alias Pupwaja and five years RI to Farooq Ahmed Chichoo after 22 years long investigation and trial.
According to the case, on October 26, 1990 information was received at Nishat Police Station that some unknown person with the intention to create terror shot dead an unidentified person.
On October 27, 1990 the dead body was disposed off as unidentified. However, on the same, Deputy Commandant 24th Battalion of BSF lodged a report with Nishat Police regarding the missing of Dharamvir Sharma. On the basis of clothing and photographs, the dead body was later identified as that of Inspector Dharamveer Sharma. Later, the investigation of the case was transferred to CBI, which after completion of investigation presented challan in the court of law.
After hearing Special Public Prosecutor M L Thusoo appearing for the CBI whereas Senior Advocate Zaffar Ahmed Shah with Advocates KL Pandita and Yogesh Bakshi for the accused persons, Presiding Officer TADA Court, Sanjeev Gupta convicted the accused.
Accused Nazir Ahmed Sheikh was sentenced to undergo imprisonment for life and a fine of Rs 5000 under Section 302 RPC. He was also sentenced to undergo imprisonment for life and fine of Rs 10,000 under Section 3(2)(i) of TADA. He was further sentenced to rigorous imprisonment for five years with a fine of Rs 5000 under Section 4 of TADA.
The Rigorous Imprisonment for seven years each under Sections 25 & 27 of the Arms Act was also awarded to Nazir Ahmed Sheikh. The Court, however, clarified that all the sentences will run concurrently.
Regarding accused Shoukat Ahmed Khan, Court awarded imprisonment for life and a fine of Rs 5000 under Section 302 RPC read with Section 34 RPC. He was also sentenced to undergo imprisonment for life and fine of Rs 10,000 under Section (2)(i) of TADA. He was further sentenced to rigorous imprisonment for five years with a fine of Rs 5000 under Section 4 of TADA. He was further sentenced to undergo RI for 10 years under Section 364 RPC with fine of Rs 7000.
However, Court awarded five years rigorous imprisonment to Farooq Ahmed Chichoo under Section 3(2)(ii) of TADA with fine of Rs 3000. The court directed that accused shall be lodged in Central Jail Srinagar to serve the sentence.
