Corruption charges framed against 2 NHPC CEs, 8 others

JAMMU, Dec 5: Special Judge Anticorruption Jammu (CBI Cases), B L Bhat has framed corruption charges against 10 accused officers including two the then Chief Engineers of the NHPC under different Sections of RPC and Prevention of Corruption Act for causing huge loss to the NHPC.
The accused officers are Babu Lal Gupta and Ashok Kumar Pandey, the then Chief Engineers of NHPC, Madan Gopal Sharma, the then Assistant Manager, Subash Chander Nayyar, the then Deputy Manager, Shiv Chand Ram, the then Senior Manager, Vijay Kumar Jain, the then ED (T&RE) NHPC, Rajesh Singh, the then Assistant Manager NHPC, Ram Dayal, Manager M/s L&T, S K Chakraborty, Sector Project Manager L&T and Shahsandra Dwivedi, MD M/s Dee Control Pvt Ltd.
According to the CBI case, in the year 2006 NHPC was entrusted with execution of work for electrification of villages and rural households in Udhampur district under Rajiv Gandhi Gram Vidyutikaran Yojna (RGGVY) by Power Development Department with the concurrence of State Government. Later, NHPC entered into two contracts with M/s L&T Ltd, New Delhi at a price of Rs 39,23,48,715 for supply of all equipment and materials besides providing all other services.
The contractor was authorized to propose sub contractors provided they meet the prescribed qualification and criteria on the date of proposal. However, as per conspiracy, Shiv Chand Ram, Senior Manager (E) NHPC initiated note sheet for approval of M/s Dee Control and Electric (P) Ltd Kanpur as sub contractor for steel poles in absence of credentials required to be submitted by the contractor along with the proposal despite the fact that M/s Dee Control was not approved as a sub vendor for MS fabricated items in any of the projects of NHPC and was not registered as manufacturer of TP or SP poles.
A K Pandey, Chief Engineer NHPC Faridabad suggested the name of firm M/s Dee Control and Electric (P) Ltd Kanpur to the contractor directing it to procure steel poles from the firm with the assurance that he would expedite approval of that firm as sub vendor though the firm was not a manufacturer of steel poles. Pandey further recommended M/s Dee Control and Electric (P) Ltd Kanpur for consideration as sub contractor for supply of steel poles though no such proposal was floated by the contractor and no documentary proof of qualifications/criteria was submitted by M/s Dee Control.
Vijay Kumar Jain, the then ED (T&RE) NHPC approved the proposal despite the fact that M/s Dee Control had no infrastructure to manufacture poles.  In the meeting held between the contractor firm and M/s Dee Control and Electric (P) Ltd Kanpur on August 10, 2007 in the office of S K Chakraborty, Senior Project Manager of M/s L&T New Delhi in the presence of Shahsandra Dwivedi, M D of M/s Dee Control and Electric (P) Ltd an agreement was made between the contractor and M/s Dee Control and Electric (P) Ltd Kanpur for supply of electric poles.
The contractor asked M/s Dee Control and Electric (P) Ltd. Kanpur to supply steel poles much before approval of later as sub-contractor or approval of its drawings of steel poles by A K Pandey on September 13, 2007. In pursuance of such criminal conspiracy, M/s Dee Control placed purchase orders with M/s Quality Steel Products Kanpur, which received payment for purchase of 7940 poles from M/s Dee Control.
Rajesh Singh, Assistant Manager (Electrical), T&RE Division NHPC conducted pre dispatch inspection of steel poles in Kanpur falsely certifying that he had inspected the poles in the premises of M/s Dee Control while the poles were lifted from the premises of M/s Quality Steel Tubes, Kanpur which was not an approved vendor.
Subash Chander Nayyar, Deputy Manager (E) REW Jammu certified the test checking of material and receipt of material as per drawings and specifications. This resulted in undue pecuniary benefit to the contractor to the tune of Rs 85,32,274 on account of procurement of SP poles and corresponding wrongful loss to NHPC and the Government.
Ram Dayal, Construction Manager M/s L&T Udhampur falsely certified that steel poles were manufactured by M/s Dee Control. Madan Gopal Sharma, Assistant Manager (C) REW Udhampur certified test checking of material but he did not point out receipt of ST poles from a non approved vendor.
