Court directs SHO to appear in person

JAMMU, Dec 14: Principal Sessions Judge Samba, Kartar Singh has issued show cause notice to the SHO Police Station Ghagwal to appear in person and explain as why out of 9 witnesses only one has been produced in the Court in the murder case. The Court also framed ROBKAR against SHO and sent a copy of the order to IGP Jammu, DIG Jammu-Kathua Range and SSP Samba.
The previous session was fixed for three days and nine witnesses were directed to be produced in the court but the prosecution produced only one witness. The Public Prosecutor submitted that he has summoned all the witnesses but the concerned Police Station has not bothered to execute the summons deliberately and intentionally.
“The submission of the Public Prosecutor carries weight. The accused are facing trial since April 19, 2011 and prosecution has filed list of 39 witnesses, which are to be examined but till date only four witnesses have been examined. This shows slackness on the part of the executing agency with whose negligence the personal liberties of accused are being curtailed and the case is not making any progress at all”, the Principal Sessions Judge observed and directed that a show cause notice be issued to the SHO Police Station Ghagwal to appear in person and explain as to why out of nine witnesses, only one witness has been produced in the court in three days.
