Court rejects bail plea of teacher involved in rape with student

JAMMU, Dec 20: Principal Sessions Judge Ramban, M A Choudhary today rejected the bail application of a Government teacher namely Joginder Singh, son of Shadi Lal of Perihote, who was allegedly involved in rape with student of 8th Class.
According to the prosecution case, on September 7, 2012, the accused, teacher in Government Middle School Hiller, told the prosecutrix that he would take her to Jammu for providing scholarship. She was asked to reach Chanderkote from where teacher will accompany her.
When she reached Chanderkot the accused made her to board a vehicle and later made her unconscious by administering something. The prosecutrix was then taken to Jammu and kept in a hotel where she was raped twice by the accused, who even threatened to kill whole of victim’s family if she dared to disclose the incident to anybody. After 4-5 days she was brought back to Chanderkote by the accused and the girl narrated entire incident to her family members.
Accordingly, a case was registered and charge sheet for commission of offences punishable under Sections 366 and 376 RPC was filed.
After hearing Public Prosecutor G N Manhas for the State whereas Advocate B A Runiyal for the applicant, Principal Sessions Judge observed, “the accused is a teacher by profession and has been accused of sexually assaulting a girl student of tender age.  The offences are serious in nature and the grant of bail to the accused at this stage will send a wrong signal in the society eroding the very confidence of the public in the criminal justice system”.
With these observations, Court rejected the bail application of Joginder Singh.
