3 months imprisonment awarded under NI Act

JAMMU, Aug 25: Judicial Magistrate Ist Class Jammu Surinder Singh has convicted one person under Negotiable Instrument Act and awarded him simple imprisonment for a period of three months.
The judgment was passed in a complaint filed by the Citizen’s Cooperative Bank Limited Branch Office Extension Counter Channi Himmat Jammu.
After hearing both the sides, the court observed, “vide interim order dated November 17, 2017 and subsequent thereto the complainant was granted further opportunities to settle the matter with the complainant bank that had advanced the accused Aditya Bakshi, son of Swadesh Mitter Bakshi of Roop Nagar car loan of Rs 4,63,000”.
“It appears that the accused had developed a tendency of seeking further time as and when he appears before the court. Even today, the accused as usual sought further time for payment”, Judicial Magistrate said, adding “the accused has admitted all accusations against him in his statement recorded under Section 242 CrPC”.
“The cheque for the amount of Rs 1,91,000 issue by the accused was dishonoured on the count of insufficient funds. Accordingly, a notice was issued by the complainant bank to the accused for making payment within a period of 15 days but still he failed to make the payment. This, all the ingredients of Section 138 Negotiable Instrument Act are satisfied and as a consequent of which the accused is convicted”, the court said.
Accordingly, the accused was awarded simple imprisonment for a period of three months and fine of Rs 2.5 lakh was imposed on the accused.
