JAMMU, Dec 31: High Court today rejected the bail application of Sandeep Gulati and Shailendra Gulati, who have been arrested by the Crime Branch in a fraud case.
After hearing Senior Advocate Sunil Sethi and Advocate Pranav Kohli for the applicant whereas Senior Advocate PN Raina with Advocates Y E Tak, JA Hamal and Rajat Gupta for the complainant and Advocate Rajneesh Oswal for the Crime Branch, Justice Sanjay Kumar Gupta observed, “this court is of the considered opinion that criminal intentions of petitioners to cheat the complainant was existing right from the execution of MoU”, adding “while considering an application for bail, detailed discussion of the evidence and elaborate documentation of the merits have to be avoided”.
“At present, there is existence of a prima facie case of cheating and duping of about Rs.12.90 crore by accused from the complainant. The nature of the accusation is severe. Investigation is at threshold; vital evidence is yet to be collected”, the High Court said while rejecting the bail application.
