JAMMU, Feb 2: Principal Sessions Judge Udhampur, A K Koul today awarded rigorous life imprisonment to father for raping his minor daughter in village Dheeran of Ramnagar tehsil on July 25, 2012.
In a rarest of the rare case where a father reduced himself to an animal raped her minor daughter, Principal Sessions Judge Udhampur Mr. AK Koul today awarded rigorous life-imprisonment and fine Rs 10,000 to Yog Raj son of Krishan Lal R/o Dheeran, Tehsil Ramnagar who committed rape with his minor daughter.
After hearing Public Prosecutor Navneet Gupta for the State, Principal Sessions Judge observed, “the trial in this case has been concluded within less than four and a half months because the case is to my understanding is rarest of rare. We need to understand that measurement of punishment in a case of this type, where the father has raped his own minor daughter in a very brutal manner, cannot depend upon the social status of the victim or accused”.
“It must dependent upon the conduct of the accused, the state and age of the sexually assaulted female and the gravity of the criminal act. The socio economic status, religion etc have no role to play in such situations. The crime of rape is crime against the society, a crime against human dignity. The accused in this case has demonstrated animal tendencies and has not even spared his own daughter. Showing any leniency towards him would mean leaving his family at his mercy”, the Court said.
“Justice demands that courts should impose punishment befitting the crime so that the courts reflect public abhorrence of the crime. At the risk of repetition it is worth mention that accused who was supposed to protect the life and limb of his daughter reduced himself to an animal and raped his minor daughter. The court does not find any mitigating circumstance in this case which could entitle the accused to some leniency”, Principal Sessions Judge said.
With these observations, Court awarded rigorous imprisonment for life to the accused Yog Raj, son of Krishan Lal of Dheeran, tehsil Ramnagar.
