PIL on construction of new Munsiff Court at Mendhar

Jammu, Mar 11: In a significant order the Division Bench of J&K High Court comprising of Chief Justice Gita Mittal and Justice Tashi Rabstan issued notices to the Commissioner Secretary GAD, Finance, Planning and others and directed Registrar General of the High Court to seek complete report pertaining to the building from District Judge, Poonch in Public Interest Litigation filed by Bar Association Mendhar through Advocate Abrar Ahmed Khan.
While appearing for the petitioners, Advocates Gagan Basotra and Abrar Ahmed Khan submitted that the Munsiff court building at Mendhar was constructed in the year 1982 and due to the increase in the population, there is also increase in the litigation and the existing Infrastructure of the building was burnt in the year 2009 due to the unrest in the town and again in the year 2011 the building was hit by the earthquake and has been declared as unsafe.
They further submitted that since then the Bar is in continuous touch with the authorities and have met the concerned by way of the deputations and representations in this regard have also been submitted but till date nothing has been done and there is no optimum working conditions in the Munsiff court Mendhar for providing justice as the building is already declared unsafe and moreover there is inadequate place for the Presiding officer to deliver Justice due to which the litigants and public at large are suffering.
After hearing this Division Bench issued notices to the Commissioner/Secretary GAD, Finance, Planning and others and directed Registrar General of the High Court to seek complete report pertaining to the building from District Judge Poonch and directed for listing of the case on April 9, 2019.
