JAMMU, Mar 25: In a Public Interest Litigation (PIL) filed by Ankur Sharma challenging Section 4 of the Jammu and Kashmir State Lands (Vesting Of Ownership to the Occupants) (Repeal and Savings) Act, 2018 and seeking retrieval of State lands from occupants/ beneficiaries, Division Bench of State High Court comprising Justice Dhiraj Singh Thakur and Justice Sindhu Sharma today issued notices to the Chief Secretary and Commissioner Secretaries of Law and Revenue returnable within four weeks.
During the course of hearing, Advocate Ankur Sharma submitted that Section 4 of the Jammu and Kashmir State Lands (Vesting Of Ownership To The Occupants) (Repeal and Savings ) Acts, 2018, arbitrarily provides immunity to the beneficiaries of infamous ‘Roshni Act’.
“The repealed legislation was conceived to reward the violators of law who instead of being booked for grabbing the State land were conferred with the ownership rights and the law being a unique piece of legislation on the statue book cannot be allowed to sustain in an organised society governed by rule of law and thus the impugned legislation being against public policy”, he submitted.
