JAMMU, Apr 12: High Court has dismissed the petition filed by DySP Shashi Thakur seeking registration of FIR against the then Director Vigilance Organization Alok Puri and Deputy Director Prosecution Vigilance Organization.
In the writ petition, the prayer was made by DySP for issuance of directions for registration of FIR against Alok Puri and Deputy Director on the basis of written information dated August 16, 2016 handed over to the Chief Vigilance Commissioner wherein it was mentioned that an attempt was made by the respondents to out-rage the modesty of the petitioner when she approached them in connection with the case relating to some land dispute.
However, the counsel for the then Director Vigilance Alok Puri submitted that writ petition was filed as a counterblast proceedings just to put undue pressure upon respondent as well as to malign and defame his clear service career. “The allegations leveled in the writ petition are totally baseless and are only aimed at putting unnecessary blot on the unblemished service profile of the respondent”, the counsel further submitted.
After hearing counsels for both the sides, Justice Sanjay Kumar Gupta observed, “from bare perusal of contents of complaint, it is evident that it doesn’t bear any date, time, month and years of alleged occurrence”, adding “a general allegation has been leveled against the accused, which cannot constitute offences under Section 354/509 RPC”.
Further, the complaint was not lodged to the concerned police but to Chief Vigilance Commissioner, who is not competent officer under CrPC to lodge FIR, the High Court said, adding “in the present case the petitioner neither has complied with the mandatory provisions of Section 154 CrPC nor has approached the Magistrate concerned before knocking at the door of this court”.
With these observations, High Court dismissed the petition for being not maintainable.
