Militants ‘guide’ acquitted, general arrest warrants against 2 Pak ultras

JAMMU, Feb 20: Principal Sessions Judge Kathua, M K Hanjura today acquitted an alleged guide of militants and issued general arrest warrant against two Pakistani militants.
According to the prosecution case, on April 23, 2005, police party recovered a bag at “Shap Nallah” under suspicious circumstances. On the search two AK-47 Rifles, 10 magazines of AK-47 Rifles, 260 cartridges of AK-47, a wireless set, a FM transistor with antenna, rifle grenades, a compass grenades, some medicines and other related items were recovered.
Accordingly, a case was registered at Police Station Rajbagh and during the course of investigation it came to fore that two persons namely Gaya and Qasim Din had acted as guides of the militants namely Abu Tallah and Ab Farman.
After completion of the investigation, Rajbagh Police presented challan and during the course of trial Qasim Din died and the proceedings were dropped against him.
After hearing PP Ravi Kumar Gupta for the State whereas Advocate Kirti Bhushan appearing for the accused, Principal Sessions Judge observed, “looking at the prosecution evidence in order to find out whether the same is, or is not credible whether the same does or does not breed confidence in the eyes of a prudent man, what strikes is that in the entire case the witnesses examined by the prosecution have not stated anywhere that the accused Gaya and Qasim acted as guides of the militants”.
“Under these circumstances when the witnesses have shaken very foundation of the prosecution case and demolished the prosecution structure, the prosecution case straight way merits the acquittal of the accused”, the Court said.
While acquitting Gaya of the charges leveled against him, Court issued general arrest warrants against accused Abu Tallah and Ab Farman, both residents of Pakistan.
